Terms of use of the site

These terms govern access to the public website of KTMA SOLUTIONS (the “site”), which presents its products and services (software, information technology services, consultants) and allows you to contact the company. They do not govern the use of KTMA SOLUTIONS products, which have their own terms. The publisher is identified in the legal notice.

By using the site, you accept these terms. We may change them; the current version and its date appear on this page. A change that would significantly reduce your rights will be announced on the site before it takes effect. Earlier versions are available on request.

Access to the site is free and does not require an account. You agree not to disrupt the site, not to attempt to access non-public areas, not to circumvent security or rate-limiting measures, not to submit unlawful content and not to use the site to send unsolicited messages.

The information on the site is general in nature. It does not constitute a firm offer, a quote, or legal, accounting or tax advice. No price is contractual unless an accepted written offer says so. We aim for the information to be accurate, without guaranteeing it.

When you use a form on the site (contact, project, quote, appointment), you provide the requested information so that we can follow up on your request. You confirm that you are entitled to share it. Do not enter passwords, banking information, health information or files about third parties. A request is received only when the site displays a confirmation of receipt; submitting a form does not create a contract. At the point of collection, the site states the purposes, which fields are mandatory or optional and your rights, and provides access to the privacy policy. The handling of your information is described in the privacy policy.

The content of the site (texts, images, trademarks, logos, layout, code) belongs to KTMA SOLUTIONS or its licensors and is protected. You may view it and quote short extracts with attribution to the source; any other reproduction or use requires our prior written authorization. Open-source software components retain their licences.

The site contains links to other websites, including KTMA SOLUTIONS product sites and third-party sites. We have no control over third-party sites; your use of them is governed by their own terms. Each KTMA SOLUTIONS product is governed by its own terms and its own privacy policy.

We make our best efforts to keep the site accessible and secure, without guaranteeing continuous availability. To the extent permitted by law, KTMA SOLUTIONS is not liable for indirect damages resulting from the use of, or inability to use, the site. Nothing in these terms limits liability for intentional or gross fault, for bodily injury, or a consumer’s mandatory rights.

These terms are governed by the laws of Québec and the federal laws of Canada that apply there. Subject to the mandatory rules protecting a consumer (who may, in particular, bring proceedings before the courts of their place of residence where the law allows it), the courts of Québec have jurisdiction. In the event of a dispute, please write to us first at contact@ktmasolutions.com; doing so does not limit your right to bring the matter before the competent authority or court.

The site is offered in French (Canada), French, English (Canada), English and Spanish. Nothing in these terms limits a consumer’s mandatory language rights. In the event of a discrepancy between language versions, the Canadian French version (fr-CA) is the reference version, subject to applicable mandatory rights, including those provided by the Charter of the French Language.
